Holiday Letting Agreement - Terms And Conditions

1.               The Tenant shall be entitled to occupy the Property for holiday purposes only and this Agreement shall not confer on the                         Tenant any security of tenure within the terms of the Housing Act 1988 pursuant to which the occupation shall be deemed                        to  be by way of an excluded tenancy

 

2.               The Tenant will:

 

2.1             pay the Rent at the times and in the manner aforesaid

 

2.2             keep the interior of the Property in a good, clean and tenantable state and condition and not damage or injure the Property                       or any part of it

 

2.3             yield up the Property at the end of the Term in the same clean state and condition it was in at the beginning of the Term                             reasonable wear and tear and damage by insured risks excepted

 

2.4             maintain at the Property and keep in a good and clean condition all of the contents of the Property as listed on the                                     Inventory, if any, and to replace, repair or cleanse any item(s) which become broken or damaged during the Term

 

2.5             not make any alteration or addition to the Property nor to do any redecoration or painting of the Property

 

2.6             not do or omit to do anything on or at the Property which may be or become a nuisance or annoyance to any other                                     occupiers of the Property or owners or occupiers of adjoining or nearby premises or which may in any way prejudice the                             insurance of the Property or cause an increase in the premium payable therefor

 

2.7             not without the Owners prior written consent (consent not to be withheld unreasonably) allow or keep any pet or any kind                         or animal at the Property.  If any pets are permitted, they must be kept under strict control at all times and must not be left                       unattended in the Property.  The Tenant will be responsible for all damage and any extra cleaning caused by the pet(s)

 

2.8             not use or occupy the Property in any way whatsoever other than as a private holiday residence for a maximum of 12 persons

2.9             not assign, sublet, charge or part with or share possession of occupation of the Property or any part thereof

 

2.10          allow the Owner or anyone with the Owner's written permission to enter the Property at reasonable times of the day to                              inspect its condition and state of repair, and carry out any necessary repairs, provided the Owner has given reasonable prior                      notice (except in emergency)

2.11          Remove all rubbish and all personal items (including the Tenant’s own furniture and equipment) from the Property at the end                  of the Term

 

3.               Subject to the Tenant paying the rental fee and performing his/her obligations under this Agreement the Tenant may                                peaceably hold and enjoy the Property during the Term without interruption from the Owner or any person rightfully                                  claiming under or in trust for the Owner

 

4.               The Owner will insure the Property and the contents of the Property which belong the Owner, as listed on the Inventory, if                       any, and make a copy of the insurance policy available to the Tenant

 

5.               In the event there being a breach of any other of the Tenant’s obligations under this Agreement then the Owner may                                recover possession of the Property and this Rental Agreement shall thereupon end but without prejudice to any of the                              Owner’s other rights and remedies in respect of any outstanding obligations on the part of the Tenant. 

 

6.               The Damage Deposit

 

6.1             The Damage Deposit will be held by the Owner and will be refunded to the Tenant at the end of the Term (however it ends)                      at the forwarding address provided to the Owner but less any reasonable deductions properly made by the Owner to cover                        any reasonable costs incurred or losses caused to him by any breaches of the obligations in his Agreement by the Tenant.                          No interest will be payable to the Tenant in respect of the Deposit money

 

6.2             The Deposit shall be payable to the Tenant as soon as reasonably practicable after the Term; however the Owner shall not                         be bound to return the Deposit until after he has had a reasonable opportunity to assess the reasonable cost of any repairs                         required as a result of any breaches of his obligations by the Tenant or other sums properly due to the Owner under clause                       6.1 However, the Owner shall not, save in exceptional circumstances, retain the Deposit for more than one month after the                     end of the tenancy

 

6.3             If at any time during the Term the the Owner is obliged to deduct from the Deposit to satisfy the reasonable costs                                     occasioned by any breaches of the obligations of the Tenant the Tenant shall make such additional payments as are                                     necessary to restore the full amount of the Damage Deposit

7.               All references to the singular shall include the plural and vice versa and any obligations or liabilities of more than one person                      shall be joint and several and an obligation on the part of a party shall include an obligation not to allow or permit the breach                      of that obligation

General Booking Terms and Conditions

CHECK-IN TIME is AFTER 4.00 P.M. local time AND

CHECKOUT is 10 A.M. local time

NO Early Check-in or late checkout.

 

This is a NON SMOKING property.

 

PAYMENT

 

In order to confirm your booking a cheque/bank transfer for 50% of the total rental fee must be enclosed/transferred with the signed Holiday Letting Agreement and Booking Reservation. If we do not receive your payment and both these signed forms within 5 days of your verbal or email confirmation, then we will release your reservation and will not be able to guarantee that the property will subsequently be available. We must receive the balance of rental fee and damage deposit no later than 6 weeks before your booking arrival date. If payment is not received by us in full and by the date given in our confirmation letter then we reserve the right to treat the booking as cancelled. In this case, cancellation charges as set out in the clause “Cancellation by you” will be applicable. NB No reminders of payment dates will be sent. Bookings received 6 weeks or less before the booking arrival date must be paid in full. Although we would not anticipate any pricing errors on the confirmation invoice, should there be obviously incorrect figures shown, then we will issue a new invoice and we will not be bound by the price shown on the incorrect invoice.

 

Damage Deposit

is NOT applied towards the rent and is fully refundable within 14 days of your departure, provided the following provisions are met;

 

  • No damage is done to property or its contents, beyond normal wear and tear.

  • No charges are incurred due to illegal activity or pets

  • All debris, rubbish and discards are placed in rubbish bins and removed from the property and soiled dishes are placed in the dishwasher and cleaned.

  • All keys to the property are returned to us on departure.

  • No linens are lost or damaged.

  • NO early arrival or late departure.

  • The renter is not evicted by the owner (or representative of the owner) or the local law enforcement.

 

CANCELLATIONS BY YOU

 

You may cancel your booking at any time. Cancellation must be communicated to us in writing and takes effect from the date received by us. In the event of cancellation then the following charges become applicable:

 

Less than 2 weeks prior to arrival date – 100% of full rental fee

Between 2-4 weeks prior to arrival date – 90% of full rental fee

Between 4-6 weeks prior to arrival date – 75% of full rental fee

 

We recommend you take out travel & cancellation insurance for your trip.

 

MAXIMUM OCCUPANCY

 

The maximum number of guests is limited to twelve persons unless otherwise agreed in writing by us before the start of your rental period.

MINIMUM STAY  

 

We require a seven (7) night minimum stay. Longer minimum stays may be required during holiday periods.

 

INCLUSIVE FEES

 

All facilities and services (water, electricity, internet, heating) are included in the rental fee. The rental fee also includes a one-time linen & towel setup, with the option of an additional set of bed linens should your rental period exceed seven days.  

 

NO DAILY HOUSEKEEPING SERVICE

 

While linens and bath towels are supplied, daily housekeeping & cleaning services are not included in the rental fee but can be arranged at an additional cost to you.  We do not permit bath towels or linens to be taken from the property, but we do provide pool towels for your use both in and outside the property.

 

SERVICES

 

The Owner shall not be held responsible for any temporary defect or stoppage in the supply of public services to the Property such as water, electricity or Internet, or in respect of any equipment, machinery, or appliances in the Property or garden, which are not caused by the Owner.

 

SWIMMING POOL

 

Use of the pool is at your own risk. No children under the age of 18 years of age are permitted in the pool at any time without adult supervision.

 

French Law: The electric Pool cover must be in place over the entirety of the pool water surface when the pool is not in bathing use.

 

DO NOT STAND ON THE POOL COVER; The cover is designed for security and insulation only. Any damage to the cover caused by guests outside normal use will be your responsibility. You will be charged for the full cost of repair or replacement, which may well be a sum greater than your initial damage deposit.

 

NO DIVING: The pool is too shallow for diving.

 

Our housekeepers will maintain, sanitise, refill and replenish chemicals in the pool prior to your arrival. We would ask however that you periodically empty the filter baskets at the end of the pool during your stay.

 

FIREPLACES

 

Fireplaces are not operational between April 15 & September 30th Incl. Please do not light anything in the fireplaces during the period mentioned above in order to prevent the risk of bush fires.

 

WATER AND SEPTIC TANK

 

Water - The mineral content in the tap water is high (hard water) but very drinkable.

 

Septic Tank - LB is on a septic tank system.  The septic system is very effective however it will clog up if improper material is flushed into it. DO NOT FLUSH anything other than toilet paper, material that you have digested or chemicals that are “Septic tank” approved.  No feminine products should be flushed at any time. If it is found that feminine products have been flushed and clog the septic system, you could be charged up to the full amount of your damage deposit.                                                                                                                          

PETS

 

PETS are neither permitted in the pool nor on any furniture. We respectfully ask that you dispose of any dog fouling in an appropriate manner to maintain hygiene in and around the house.

 

FALSIFIED BOOKINGS

 

Any booking obtained under false pretences will be subject to forfeiture of advance payment, deposit and/or rental money, and the party will not be permitted to check in.

 

RATE CHANGES

 

Rates are subject to change without notice.

 

WRITTEN EXCEPTIONS

 

Any exceptions to the above mentioned policies must be approved by us in writing in advance of your stay.

 

FORCE MAJEURE

 

We the Owners regret that we cannot, either jointly or individually, accept liability to pay you or your Guests any compensation if your holiday is affected by any event which is beyond our reasonable control. These events include (but are not limited to) war, threat of war, terrorist activity and its consequences or the threat of such activity, civil commotion, riot, the act of any government or other national or local authority including port authorities, industrial action by third parties, natural or nuclear disaster, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster or failure of public or private telecommunications networks.

YOUR CONTRACT

 

A binding contract comes into existence when your booking is confirmed by telephone (when you are booking 6 weeks or less before departure) and in all other cases when we receive the first 50% payment for your holiday booking period and a signed Holiday Lettings Agreement. This contract is governed by English Law. It is mutually understood and agreed that any dispute, claim or any other matter that arises out of this contract or your holiday will be dealt with by the courts of England and Wales.
